Rules for Collection of Fees, Terminating Services & Liens

Pursuant to Sec. 4.1, 4.6, 5.4 & 8.1 of the Declaration of Restrictions for Plat VI and VII and the Restatement of Declaration of Restrictions for Plats II, III & IV as to Hidden Harbour, a Subdivision in the Township of Springfield, Lucas County, Ohio, the Hidden Harbour Homeowners’ Association Board of Trustees adopted the following rule for collection of unpaid Association fees, termination of services and liens.

  1. Accounts (including association fees, costs, lien expenses, late charges and fines) not paid within 30 days from the date a lien was recorded and notice given to the resident will be charged $30 per month or part thereof until paid.
  2. Association fees not paid after 60 days from billing shall result in:
    a. termination of all services to the resident including refuse and yard waste pick up.
    b. the recording of a lien upon any property that is for sale.
  3. Association fees not paid after 120 days from billing shall result in the recording of a lien upon the property.

Rule for Maintenance of Property

[Refuse, grass, weeds and failure to mow and maintain] Pursuant to Sec. 4.1, 4.6, 5.4 & 8.1 of the Declaration of Restrictions for Plat VI and VII and the Restatement of Declaration of Restrictions for Plats II, III & IV as to Hidden Harbour, a Subdivision in the Township of Springfield, Lucas County, Ohio, the Hidden Harbour Homeowners’ Association Board of Trustees adopted the following rule and schedule of fines for failure of a property owner to properly maintain their property:

Upon the determination of the HHHA Board, by majority vote, with or without a complaint, that a property owner is not maintaining his/her property in conformity to the general standard of the community, specifically that any 1 or more of the following conditions exist:

A. Grass, weeds or any growth higher than 6”;
B. Absence of living grass in 50% or more of the lawn area;
C. Presence of any refuse or other discarded material, in or out of containers, anywhere on the lot, for a period of more than 10 days.

The HHHA Board shall notify the owner in writing of the violation and demand that the violation be remedied and corrected within 15 days.

If the violation is not remedied and corrected at the expiration of the 15 days the owner shall be fined $10 a day until the violation is corrected.

If the violation is not remedied and corrected after 15 days of fines the Association may remedy and correct the violation and shall bill the owner for the cost thereof.

If the fine and/or cost of remediation incurred by the Association is not paid and reimbursed within 30 days from date of billing the owner, the Association may then record a lien for the fines, costs, expenses, attorneys’ fees and other expenses incurred to remedy and correct the violation and record the lien.
